Please read these Terms of Service ("Terms") carefully before using the Dreamy mobile application (the "Service") operated by Dreamy ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the Terms then you may not access the Service.

1. Eligibility

You must be at least 13 years of age (or 16 in the European Economic Area) to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Service.

2. Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. Subscriptions and Payments

Some features of the Service require a paid subscription ("Premium").

• Billing: Subscriptions are billed through the Apple App Store or Google Play Store. By purchasing a subscription, you agree to the payment terms presented to you at the time of purchase.
• Auto-renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the applicable subscription fee for the next billing period unless you cancel.
• Cancellation: You can cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
• Price changes: We may change subscription prices from time to time. Price changes will take effect at the start of the next billing period following notice to you.
• Refunds: Refund requests are handled by Apple or Google in accordance with their respective refund policies.

Free users may access limited features, including a maximum of 3 dream entries per day per device.

4. AI-Generated Content

Important: The Service uses artificial intelligence to generate dream analyses, dream images, chat responses, dream titles, dream tags, and daily affirmations. You acknowledge and agree that:

• AI-generated content is produced by automated systems and may not always be accurate, complete, or appropriate;
• Dream analyses and interpretations are for entertainment and informational purposes only;
• AI-generated content does not constitute professional psychological, medical, therapeutic, or any other form of professional advice;
• You should not rely on AI-generated content for making health, mental health, or other important life decisions; and
• If you are experiencing mental health concerns, please consult a qualified healthcare professional.

5. User Content

5.1 Your Content

You retain ownership of the dream descriptions, notes, and other content you submit to the Service ("User Content"). By submitting User Content, you grant us a limited, non-exclusive, worldwide license to process, transmit, and use your User Content solely for the purpose of providing and improving the Service, including sending it to third-party AI services for analysis and image generation.

5.2 Content Moderation

We use automated content moderation to review User Content before AI processing. We reserve the right to refuse processing of any content that violates our guidelines or applicable law.

5.3 Prohibited Content

You agree not to submit content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable;
• Exploits or harms minors in any way;
• Attempts to manipulate, exploit, or bypass our AI systems; or
• Violates any applicable law or regulation.

We reserve the right to remove or refuse to process any content at our sole discretion.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Dreamy and its licensors. AI-generated content (analyses, images, etc.) created through the Service is provided for your personal, non-commercial use.

7. Links to Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Dreamy.

Dreamy has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You acknowledge and agree that Dreamy shall not be responsible or liable for any damage or loss caused by or in connection with use of any such third-party content or services.

8. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service and uninstall the app.

All provisions of the Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that: (a) the Service will function uninterrupted or error-free; (b) AI-generated content will be accurate or reliable; or (c) any defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Dreamy, its directors, employees, partners, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort, or any other legal theory.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. These Terms constitute the entire agreement between us regarding the Service.

12. Changes

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect by posting notice within the app or on our website. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the Service.
